Surprising Supreme Court Ruling On Facebook Threats
The Supreme Court delivered a surprising ruling regarding threats made on Facebook - http://www.parientelaw.com Michael Pariente (a top Las Vegas-based criminal defense attorney) delivers his opinion on the overturning conviction in Elonis v. U.S,, especially because it was a 7-2 decision, with Chief Justice Roberts writing for the court. That means the court’s liberal wing, the moderate-conservatives (Kennedy, Roberts) and even Justice Scalia were all in agreement.
The case involved Anthony Elonis, a Pennsylvania man who used Facebook to make a series of violent rants against his wife and others, often citing the rapper Eminem and using hip-hop lyrics.
The basics of the ruling centered around principles of "free speech" and probably were at the center of such a landslide decision especially this conservative Supreme Court. They stated that simply quoting lyrics or going on Facebook rants is not you legal and less the subject goes out and follows up with them in some physical fashion, such as buying a gun and driving repeatedly around his girlfriend's house (for example).
This is the first time the Supreme Court has ruled on anything regarding Facebook or any type of social media including twitter and some speculate that this decision will reverse many of the anti-bullying laws that are already on the books. This may have been the first we've heard from the Supreme Court regarding the validity of making threats are going on rants on Facebook, but it will not be the last.
